These terms are an agreement between you and the maker of Cloudy, an independent developer based in Taichung, Taiwan ("Cloudy", "we", "us"). They cover the Cloudy Mac app ("the app") and this website. By downloading, installing or using Cloudy you agree to them. If you don't agree, don't use Cloudy.
1. Who can use Cloudy
You must be at least 13. If you are under the age of adulthood where you live, you need a parent or guardian's permission, and they accept these terms for you.
2. Your license
We give you a personal, non-exclusive, non-transferable license to use the app on Macs you own or control, under these terms. Cloudy Free is free to use. Cloudy Pro is not on sale yet; when it is, a Pro license is planned to unlock the Pro features for one person on up to 2 Macs.
You may not: copy, sell, rent or redistribute the app or license keys; share a license beyond its limit; reverse engineer, decompile or modify the app except where the law allows it; or bypass or tamper with licensing, trials or free-plan limits.
3. Free plan, trial and Pro
Free-plan limits (such as the number of messages or images per few hours and Scan and Answer uses per day), the length of the Pro trial, and which features are free or part of Pro are described on our pricing section. They may change at any time, not only in new versions: the app downloads the current limits from meetcloudy.com and applies them automatically. We may also pause a feature for everyone for a while, for example to fix a problem. Both the free plan and Pro get updates to Cloudy for as long as we offer them. Pro is planned as a one-time purchase and may get some new features before the free plan does ("early access"); early access is not a promise of any particular feature or timing, and features may later move to the free plan.
4. Your AI provider, your key
Cloudy uses an AI model you choose. With a cloud provider (OpenAI, Anthropic, Google), you use your own API key and account: you are responsible for that provider's fees, for keeping your key safe, and for following that provider's terms and usage policies. We are not responsible for providers' services, outages, prices or changes.
5. AI can be wrong
Answers come from AI models and can be incorrect, incomplete or out of date. Check anything important yourself. Cloudy does not give professional (for example medical, legal or financial) advice.
6. When Cloudy uses your Mac
With computer use, Cloudy clicks and types on your Mac when you ask it to. AI can misunderstand or make mistakes, so watch what it does and press Esc to stop it at any time. Don't ask it to handle passwords, payments, purchases, deleting data or anything you can't easily undo. You are responsible for the actions you ask Cloudy to take and their results.
7. School, exams and work rules
Scan and Answer and the other features are meant for practice, study and productivity, not for getting answers during tests. You are responsible for following the rules of your school, teachers, exams, employer and any other services you use. Don't use Cloudy where AI help is not allowed, such as in exams or graded work that forbid it.
8. Acceptable use
Don't use Cloudy to break the law, to harm, harass or deceive others, to access systems or data you're not allowed to, or to break the terms of other apps or websites.
9. Buying Pro
Cloudy Pro isn't on sale yet. The terms for buying it will be added here before it is. Nothing in these terms limits the consumer rights you have under the law where you live.
10. Updates and changes
We may update, change or discontinue features of Cloudy. The app installs updates when you allow it. We may update these terms; the date at the top shows the latest version, and continuing to use Cloudy after a change means you accept it.
11. Ownership and trademarks
Cloudy, its character, name, artwork and code belong to us. Apple, Mac and macOS are trademarks of Apple Inc. OpenAI and GPT are trademarks of OpenAI. Anthropic and Claude are trademarks of Anthropic. Google and Gemini are trademarks of Google LLC. Ollama is a trademark of its owner. Cloudy is independent and not affiliated with or endorsed by any of them.
12. No warranty
To the extent the law allows, Cloudy is provided "as is" and "as available", without warranties of any kind, including that it will be error-free, uninterrupted, accurate or fit for a particular purpose.
13. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, profits or grades, arising from your use of Cloudy, of AI answers, or of actions Cloudy takes at your request. Our total liability for any claim is limited to the amount you paid us for Cloudy in the 12 months before the claim, or NT$990 if that is more. Nothing here limits liability for our intentional misconduct or gross negligence, or anything else the law does not allow us to limit. Some places don't allow these limits, so they may not apply to you.
14. Ending
You can stop using Cloudy at any time by deleting it. We may end your license if you seriously break these terms. Sections 5 to 8 and 11 to 15 continue after that.
15. Law and disputes
These terms are governed by the laws of Taiwan (Republic of China). Disputes go to the Taiwan Taichung District Court as the court of first instance, unless the consumer law of the place where you live gives you the right to use your local courts.
